Jay Smith's Student Lizzie Schofield Believes Jesus Mistreats Women in Deut 21:10-14


Lizzie Schofield of Pfander Ministries as a Trinitarian believes Jesus allowed Israelites to mistreat captive women by marrying them after killing their fathers, husbands and brothers in battle. Of course she was trying to launch a shallow Jay Smith-esque polemic against Prophet Muhammad's marriage to Safiya (which is discussed here) but nevertheless, if she'c consistent, she will as a Trinitarian believe Jesus allowed something which she believes to be ill-treatment of women:

After that you may go in to her and be her husband, and she shall be your wife.

My advice to Lizzie, look why not just accept the Islamic view of Jesus? Do you really want to believe Jesus ordered the killing of women and children and allowed the severe beating of female slaves as long as they got up within a day or two?

Pfander's Beth Grove Asked to Apolgise to Hashim For Anti-Muslim Abuse: Speakers Corner


This "Christian" lady called Beth Grove of Pfander Centre for Apologetics reveals her vile anti-Muslim bigotry when a Muslim speaker, Hashim, at Speakers Corner makes comments on Numbers 31.

15 Moses said to them, “Have you let all the women live? 16 Behold, these, on Balaam's advice, caused the people of Israel to act treacherously against the Lord in the incident of Peor, and so the plague came among the congregation of the Lord. 17 Now therefore, kill every male among the little ones, and kill every woman who has known man by lying with him. 18 But all the young girls who have not known man by lying with him keep alive for yourselves.

The video deals with her bigoted anti-Muslim abuse. She took exception to the thought rape was of the virgin girls took place. She then angrily lashes out and claims this idea of rape being involved in Numbers 31 of the Midianite virgins is due to a Muslim mentality: "thinking like a Muslim". A vile anti-Muslim comment which she needs to be publicly called out on, hence this post peacefully rebuking her and calling her to publicly apologise.

However, the more observant ones amongst you may have noticed she made no pronouncement on what is apparent in the text: male children and mothers (non virgin women) were killed.

She does not put this down to a "Muslim" mentality. Why not? Because her bigoted ranting and name-calling cannot detract from a plain reading of the Bible. She believes Moses ordered such. She believes Moses is a Jew, why didn't she put that down to a "Jewish" mentality? It's obvious:

1. She believes Moses is a Prophet and the vengeance against the Midianites was ordered by the Lord (as a Trinitarian this order comes from Jesus in her eyes as he is considered to be the 2nd person of the Trinity doctrine):

1 The Lord spoke to Moses, saying, 2 “Avenge the people of Israel on the Midianites. Afterward you shall be gathered to your people.”

7 They warred against Midian, as the Lord commanded Moses, and killed every male.

25 The Lord said to Moses, 26 “Take the count of the plunder that was taken, both of man and of beast, you and Eleazar the priest and the heads of the fathers' houses of the congregation, 27 and divide the plunder into two parts between the warriors who went out to battle and all the congregation.

2. It would be anti-Semitic to make a similar comment about Jews - something which would receive widespread (and rightful) condemnation from the public and it could get her into trouble with the law of the land. In effect, she's a coward and a bully as she's picking on the minority which is not as well protected when it comes to abuse and discrimination. Sadly, there are a number of Christians who feel they can get away with anti-Muslim comments and sentiment without being called out for bigotry, publicly condemned and reported to the authorities. Muslims have to do more to ensure anti-Muslim abuse is seen as severe and as reprehensible in the eyes of decent people in the UK as anti-Semitism is seen. We can learn from our Jewish friends as they have decades of experience in campaigning against discriminatory attitudes against their people - we should invite Jewish activists to help us with our activism against Islamophobia. Our Jewish friends have a lot of experience and knowledge we can benefit from.

Just to give you an idea of the number of male youngsters and mothers killed here, think about the number of virgin girls and then do the maths:

Verse 35 tells the reader how many virgins there were: and 32,000 persons in all, women who had not known man by lying with him.

If we say the number of boys killed was roughly the same as the spared virgins then we are talking about 30,000 boys killed. What about the mothers? If we say each mother had 6 children then we are talking about 10,000 mothers. That's roughly 40,000 boys and mothers killed.

For Beth Grove to resort to bigoted ravings at the suggestion the text teaches there was rape one wonders what she does at the thought of the 40,000 boys and mothers being killed....Crickets.

This is typical of your average Christian anti-Muslim bully. Ranting and raving abuse and allegations at Muslims but no consistency and serious-minded thought.

Just to nail my colours, as a Muslim, to the mast. I don't have a belief about this story about Moses. There's no compulsion on me to accept it. I, and the Muslim in the video, do not believe the historical Moses allowed rape of anyone. We don't consider the Old and New Testament reliable.

We must not forget anti-Muslim bigotry attracts other anti-Muslim types. Some of Beth's and Pfander Ministries viewers/followers/supporters/casual observers have been documented in making threatening and racist abuse.

The quotes used in the video to show there are other folks out there who think the text in Numbers 31 implies rape, at least one of these other people is a CHRISTIAN.

Emeritus Professor of Statistics at Auckland University, New Zealand and a Fellow of the Royal Society of New Zealand Arthur F. Seber writes:

“God seems to sanction rape. In Numbers 31:17-18 we read that Moses encouraged his men to kill all the boy captives and female captives who are not virgins but keep virgins alive for themselves. God did not rebuke him but urged him to distribute the spoils (verses 25 40).” [1]

In a massive commentary on the Bible, The theologian Claudia Rakel writes:

“The connection between war and the rape of the women of the conquered people is recorded in biblical texts such as Numbers 31, Genesis 34, and Judges 5:30.” [2]

Eminent scholar Professor Carolyn J. Sharp, who is Acting Associate Dean of Academic Affairs & Professor of Hebrew at the Divinity School of Yale University identifies the text in Numbers as an example of a prescription for rape:

“The practice of sexual violation of enemy women for the purpose of long-term destabilization of the enemy is a well-known and amply documented strategy of male warriors in many cultures, from ancient times to today. Scripture testifies to this abhorrent practice in holy-war texts such as Numbers 31:18, in which Moses commands the execution of nonvirgin Midianite women but allows his army to “keep alive for” themselves Midianite virgin girls, and Deuteronomy 20:14, which instructs that enemy women may be taken as booty.”

Professor of Social Ethics and Latinx Studies at Iliff School of Theology in Colorado, Dr. Miguel A. De La Torre, who is also an ordained Southern Baptist minister, readily recognises the plain meaning of Numbers 31:18: “The abolitionists were hard pressed to find any biblical passage that outright condemned the institution of slavery. Even the rape of female slaves found biblical justification and was considered to be ordained by God. Specifically, Numbers 31:18 instructs conquerors as follows: “You shall keep alive all young females who have not had sex with a male for yourselves.” This passage is part of Moses’ instructions for treatment of the conquered people of Midian, who were now to be Israel’s slaves.” [1]

"UK Government Allowed British Muslims to Rape English Girls for Votes" - Anne Marie Waters Propganda Exposed


This was the vile propaganda a lady called Anne-Marie Waters was presenting at Speakers' Corner in London. It's indicative of the hateful propaganda Muslims in Europe are subjected to.

In this video we look at Anne Marie Waters' lies with the lens of consistency and correction.

Firstly, let's put an end to this malicious lie that Sharia allows rape. Here's what two prominent Muslim scholars have said about rape:

Anne Marie Waters read reports of criminal Muslims in Britain who raped English girls (all communities have criminals in them) and she decided to  disingenuously link this with Sharia in order to further her anti-Muslim  agenda. As we can clearly see from the unambiguous quotes above from authorities on Islam, Sharia does not allow rape.

However, I wonder if Anne-Marie Waters would be consistent when it comes to labelling whole communities and religions as rapists based on a few criminals within the said community. In the video I highlight reported claims of forced sex within the US army, would Anne-Marie Waters say Christian and American law allows this? I also used a headline about our UK armed forces, an organisation which is plagued by male rape - would Anne Marie Waters claim the UK government allows Christian/Atheist soldiers to rape other males for votes?

A Response to The Times Headline 'Koran Encourages Rape: How Isis fighters justify making sex slaves of girls'


Firstly we have already seen that rape in general is reprehensible according to Islam through Muslim scholarly authorities. Secondly we know Islam does not allow the rape of female slaves either.

Thirdly, here's a piece posted by Dr Jonathan AC Brown to counter some of the Islamophobic claims about rape in Islam:

In light of the misinformation and ignorance being batted around over the issue of Rape in Islamic Law, here is the text of Hina Azem’s excellent entry on it from the Oxford Encyclopedia of Islam and Law (of which I am admittedly the editor in chief):

Classical Islamic law defined what we would call “rape” as a coercive form of illicit sex or fornication (zinā). This basic definition of rape as “coercive zinā” meant that all the normal legal principles that pertained to zinā – its definition, punishment, and establishment through evidence – were applicable as well to rape: The prototypical act of zinā was defined as sexual intercourse between a man and a woman over whom he has neither a conjugal nor an ownership right. Sane adult male and female participants to zinā were to receive a fixed corporal punishment (ḥadd): one hundred lashes and exile for unmarried free persons, stoning to death for married or previously married free persons, and fifty lashes (without exile) for slaves. Zinā was established, according to classical law, through either confession of one or both parties, or through the concurrent eyewitness testimony of four sane adult males. (It was unanimously agreed that women’s testimony was excluded in the ḥadd crimes, including zinā.) A third type of evidence – pregnancy in an unmarried/unowned woman – was contested between the schools. The stringent evidentiary and procedural standards for implementing the zinā punishment may have functioned to offset the severity of the punishment itself, an effect that seems to have been intended by legal authorities, who in the early period developed legal maxims encouraging averting the ḥadd punishments as much as possible, whether through claiming ambiguity (shubha) or a lack of legal capacity (ahliyya).

Muslim authorities recognized from the earliest period, however, that not all acts of zinā were mutually consensual, and that the legal principles meant to address cases of consensual zinā were not easily applicable in cases of coercion. Muslim judges and jurists thus developed a theoretical apparatus through which to analyze the various complexities raised by coercive zinā. This classical theoretical apparatus used consensual zinā as its basic framework, but expanded it in important ways.

What distinguished a prototypical act of zinā from an act of “rape,” for the jurists, was that in the prototypical case, both parties act out of volition, while in an act of “rape,” only one of the parties does so. Jurists admitted a wide array of situations as being “coercive” in nature, including the application of physical force, the presence of duress, or the threat of future harm either to oneself or those close to oneself; they also included in their definition of “coercion” the inability to give valid consent, as in the case of minors, mentally ill or unconscious persons. Muslim jurists from the earliest period of Islamic law agreed that perpetrators of coercive zinā should receive the ḥadd punishment normally applicable to their personal status and sexual status, but that the ḥadd punishment should be averted from victims of coercive or non-consensual zinā due to their reduced capacity.

The jurists drew a general status distinction between free persons and slaves, and this distinction is reflected in all areas of the law, including rape law. There are several notable differences between the juristic discussion of sexual violation between free persons and sexual violation involving slaves, all of them stemming from the legal status of slaves as property rather than proprietors. The first is a difference in terminology and placement in legal works. Violation of free women is normally described as “coercive zinā” (al-istikrāh ʿalā al-zinā) and the victim as the “coerced woman” (al-mustakrahah), and substantive discussions are normally found in chapters on ḥudūd and zinā. Violation of slavewomen, on the other hand, is normally described as “property usurpation” (ghaṣb) and the victim as “usurped property” (maghṣūbah), and substantive discussions are normally found in chapters on ghaṣb. The second notable difference is the pointed attention to the volitional state of free women in acts of zinā and the frequent lack of attention to the volitional state of slavewomen in acts of ghasb. For the jurists, sexual usurpation of a slavewoman was a form of property damage that required financial compensation to her owner for depreciation. The consent or coercion of the slavewoman to the act, while important for determining whether or not she should get the ḥadd punishment, was irrelevant to assessing depreciation. A third key difference between the violation of free women and slavewomen is closely related to the previous point: The jurists were in agreement that violation of slavewomen required financial compensation to owners, usually equal to the amount by which she was depreciated by the act (this being of particular relevance if she was previously a virgin). Such agreement on monetary compensation was not found in the case of free female rape victims, and this latter point remained heavily contested between the schools of law, as follows:

According to the Mālikī, Ḥanbalī and Shāfi`ī schools of law, the rape of a free woman consisted of not one but two violations: a violation against a “right of God” (ḥaqq Allāh), provoking the ḥadd punishment as we have seen above, and also a violation against a “human” or interpersonal right (ḥaqq ādamī), provoking a monetary compensation. These jurists saw the free woman, in her proprietorship over her own sexuality (buḍ`), as not unlike the slaveowner who owns the sexuality of his female slave. For them, in the same way that the slaveowner was entitled to compensation for sexual misappropriation, the free woman was also entitled to compensation. The amount of this compensation, they reasoned, should be the amount that any man would normally pay for sexual access to the woman in question – that is, the amount of her dower (ṣadāq or mahr). Islamic juristic thinking thus relied not only on the logic of zinā to deal with rape, but also on the logic of marriage: In the case of slavewomen, rape was specifically analogized to usurpation of sexual property, and the case of free women, it was analogized to a usurped conjugal right. In any case, the dower compensation was only seen as applicable if intercourse had taken place; assault of a free woman that excluded vaginal penetration – such as manual defloration – did not provoke the dower fine. (In the case of slavewoman, manual defloration could result in a fine, as it was regarded as a damage to property.)

As against the other Sunni schools, the Ḥanafī school rejected the principle of a dower compensation to free victims of rape. For this, they relied on a few key principles: The first was what they perceived as a necessary hierarchy and consequent conflict between the “rights of God” (ḥuqūq Allāh) and the “rights of persons” (ḥuqūq ādamīya). According to the Ḥanafīs, in cases of combined violations against both God and persons (of which rape was a type), the right of God – that is, the imposition of the ḥadd punishment – trumped the personal right of the woman to compensation for sexual usurpation: If and when the ḥadd zinā was imposed, the dower fine was to be dropped. The second principle was the rejection of the analogy of rape to marriage, which functioned critically in the discourse of the other schools. The dower that served as an exchange value for sexual right in marriage could not be applied, they argued, in the case of rape, which was a form of zinā. Providing a monetary award to a rape victim would be analogous to paying a prostitute. (A minority opinion within the Ḥanbalī school should also mentioned, which was that a compensation for wrongful sex is only payable in the case of virgins, not matrons.)

The evidentiary rules for establishing rape fell into two categories, depending on what was sought – imposition of the ḥadd zinā on the perpetrator or monetary compensation to the victim. Insofar as rape was a type of zinā, the jurists theorized that it could only be established through the same means as consensual zinā – confession or eyewitness testimony of four adult male witnesses. If neither form of evidence could establish with certainty that penetration had occurred, or if the perpetrator had reduced capacity (due to minority, for example), then the ḥadd punishment could not be imposed on the perpetrator. However, the judge might impose a discretionary corporal punishment (taʿzīr) if he felt there was enough circumstantial evidence to support her claim. This line of thought is most fully developed by the Mālikī scholars, and least so by the Ḥanafī scholars.

As for her claim to the dower compensation (among those who accepted it), the legal texts suggest that it was to be handled like any other civil claim (daʿwā or istiḥqāq), in which the claimant seeks to establish testimony through two male witnesses or one male and two female witnesses, or one male witness and an oath. If the claimant is unable to bring sufficient evidence to support her charge, the defendant would presumably have a choice between either acknowledging her claim or denying it through an oath, in which case the charges would be dropped. The efficacy of this system for civil claims in rape cases is unclear, however, because of certain complications: First, the system seems to be intended for breaches of contract, rather than crimes; bringing even one witness to the concomitant events surrounding an act of rape could be nearly impossible for a victim. Second, oaths are specifically rejected in establishing the rights of God, of which rape is a type. Third, charging someone for rape with less than the four requisite witnesses would expose both the witnesses and the claimant to charges of slander (qadhf), which itself is punishable. The classical school texts do not entirely address the difficulties of applying civil claims procedures in the context of rape charges, but seem to leave room for judges to interpret and apply these different rules as they see appropriate. Of the Sunni schools, the Mālikī school goes furthest to establish ways that a rape victim might mount a successful claim for compensation without sufficient eyewitness support or only circumstantial evidence. This may be due to the fact that of the four schools, only the Mālikī school holds pregnancy in an unmarried woman to be proof of zinā and therefore punishable; the other three schools withhold punishment in this context, on the presumption that she may have been raped. A rape victim in Mālikī jurisdiction, therefore, would be forced to report the crime and bring charges against her assailant, so as to avert punishment should she later show pregnancy. It may be that an acute awareness of the difficult position in which rape victims found themselves prompted Mālikī jurists to develop a more workable theory of evidence than the other schools.

Imāmī Shiite jurisprudence on rape is similar to Sunni jurisprudence in basic respects, yet has some appreciable differences. Shiite authorities agreed that the ḥadd punishment for zinā was to be imposed on the perpetrator of rape while averted from the victim. Their arguments for this averting were based not so much on the mitigating role of coercion/invalid consent in application of the ḥadd penalties, but rather on the idea that the rape victim had not actually committed zinā, in the first place, an act that requires intent. As for the punishment to be applied on the perpetrator, Shiite law was univocal in supporting an intensified version of the ḥadd zinā, namely execution by the sword rather than the normal ḥadd zinā (which was flogging for the unmarried and stoning for the previously married).

Shiite jurists were divided over the appropriateness of compensating the free victim of rape in the amount of her dower (mahr or ʿuqr). Some argued that there is no compensation for the victim, based on ʿAlī’s precedent and the Prophetic saying that there is no compensation for the prostitute (baghy), and also on the foundational principle of freedom from liability (barā’at al-dhimmah). Others argued that the victim should receive compensation, as she is neither a prostitute nor a fornicatress (zāniyah), and on the notion that dower payment is the bloodprice (diyah) for the usurped vulva (al-farj al-maghṣūb). In stating their positions on this topic, the Shiite jurists frequently refer to the Sunni Abū Ḥanīfa, who opposed any compensation, and to al-Shāfiʿī, who supported it. Shiite jurisprudence is also multivocal on the correct amount of damages payable to the owner of a sexually misappropriated slavewoman. Some argued that the owner is owed 1/10th of her price if she was a virgin and 1/20th is she was a matron, while others argued that the owner is owed her dower (mahr), as well as a separate fine for defloration if she was a virgin (called arsh al-bakārah).

Another notable area of difference between Sunni and Shiite jurisprudence concerns the liability of the insane to the ḥadd zinā. According to Sunni law, the ḥadd is to be averted from all who have defective legal capacity, such as minors, the insane, and the unconscious, regardless of gender. According to some Shiite jurists, a distinction is to be made between insane men and insane women who commit zinā: While the ḥadd is to be averted from insane women, it is imposed in full upon insane men. Others, however, rejected this gender distinction, and affirmed that insane men, too, should be spared the ḥadd punishments. The Sunni parallel to this exploration of the relationship between legal capacity and sexual agency is the Sunni discussion of a man being coerced to zinā with a woman by a third party. This is debated with some vigor, with attention given to whether a coerced or fearful man can be aroused to perform, whether his enjoyment is indicative of guilt, and whether it matters if the coercion is exerted by a state authority or not.

A few outlying issues should also be addressed. Classical Islamic law drew a line between rape intra-Muslim and intercommunal rape. If a Muslim male violated a non-Muslim (dhimmī) woman, the sentence would be the same for him as if she were Muslim. However, a dhimmī man’s assault against a Muslim woman was considered a violation of the intercommunal political treaty under which dhimmīs lived in Muslim lands, and so was to suffer execution. Same-sex violation is addressed only in a limited fashion, in the context of sex between an adult male and a minor male; assault of one man by another, or one woman by another, receives little or no attention. Both Sunni and Shiite legal sources give considerable attention to injury (jināyah) that may occur in the course of coercive zinā, particularly tearing of the perineum, such as happens with the use of excessive force or where the victim is a minor. The general opinion of the Sunni schools was that a partial tear provoked a fine in the amount of 1/3 her bloodprice (diyah), while a total tear (such as causes incontinence and could even lead to death) prompted a full bloodprice. The Shiite jurists generally agreed to assign her a full diyah, and debated the necessity of also assigning her the dower (as we have seen above)

Comments on Saudi Rape Victim Sentenced to 200 Lashes


This is an odd story. The 'report' says the gang rape victim was sentenced 200 lashes and six months in jail. It's important to stress the authorities did not sentence her for being raped but for other reasons.I'm not sure if this story is true but one thing that is true is that the rape victim is not meant to be punished for being raped according to Islam:

Is the rape victim punished for being raped? No!
Ibn `Abdul-Barr (may Allah bless his soul) said

There is no punishment for the woman if it is true that he forced her and overpowered her. (Al-Istidhkaar, 7/146).

To punish the rapist, are four witnesses required? No!

Sheikh Rabbani states: The four witness requirement applies only to the prescribed hadd punishment (which in the case of a married person could be death and for the non-married, 100 lashes). [Marghinani, Hidaya] This punishment is only applied in very rare cases, as is clear, and is meant to be a social deterrent, above all.

As the classical and contemporary jurists (such as Mufti Taqi Usmani) have made clear, a rapist can be convicted on lesser evidence (including scientific evidence, such as DNA tests and medical reports) for discretionary punishments. These discretionary punishments are left up to the legal system to determine.

Report from Press TV concerning a rape victim in Saudi Arabia who has been sentenced to 200 lashes.

A Saudi woman who had fallen victim to a violent gang-rape has been sentenced to 200 lashes and six months in jail after being found guilty of speaking to the media about the crime and indecency.
The Shia woman, 19 years old back in 2006, was in the car of a student friend when two men got into the vehicle and drove them to a secluded area, where she was raped by seven men, the Middle East Monitor reported on Friday.
She was initially sentenced to 90 lashes for being in the car of a strange man, because the Saudi law dictates that a male family member must accompany a woman at all times in public.

Are Muslims allowed to have sex slaves?

The net is really tightening on Anti-Islamic folk who propagate the deception of Muslims being allowed to rape slave women. I have already posted this interesting number to counter their falsehood and expose their propaganda:

It’s commonly claimed by some critics that Islam allows Muslims to have sex slaves. Their reasoning behind this argument is that there are verses from the Quran that talk about Muslims being allowed to have right hand captives, for example the following verse:
33:50 O Prophet! We have made lawful to thee thy wives to whom thou hast paid their dowers; and those whom thy right hand possesses out of the prisoners of war whom Allah has assigned to thee..
And then from the hadith:
Narrated Abu Said Al-Khudri that during the battle with Bani Al-Mustaliq they (Muslims) captured some females and intended to have sexual relations with them without impregnating them. So they asked the prophet about coitus interruptus.  The prophet said, “It is better that you should not do it, for Allah has written whom He is going to create till the Day of Resurrection”.Qaza’a said, “I heard Abu Said saying that the prophet said, “No soul is ordained to be created but Allah will create it.”” (Sahih Bukhari Volume 9, number 506)
So from such Quranic verses, and hadiths, the critic makes the argument that this is proof of sexual slavery and that Muslims are allowed to rape their right hand captives.
 
Now if you actually read the verse, and hadith again, nowhere does it say anything about raping, or forcing a female captive to have sex. This is something the critic has literally made up, they have jumped and made the argument, that since the hadith talks about sex, it must mean rape. So the argument actually says more about their minds and what they’re thinking, rather than what the Quran and hadith are saying.
 
Not only do these texts say nothing about raping your captives, we do in fact have Quranic verses, hadiths, and scholarly opinions that forbid such acts. The Quran for example says:
“Let those who find not the wherewithal for marriage keep themselves chaste, until God gives them means out of His grace. And if any of your slaves ask for a deed in writing (to enable them to earn their freedom for a certain sum), give them such a deed if ye know any good in them: yea, give them something yourselves out of the means which God has given to you. But force not your slave-girls to prostitution when they desire chastity, in order that ye may make a gain in the goods of this life  (The Noble Quran, 24:33)”
This verse was revealed after the following incident:
Narrated Jabir ibn Abdullah:  “Musaykah, a slave-girl of some Ansari, came and said: My master forces me to commit fornication. Thereupon the following verse was revealed: “But force not your maids to prostitution (when they desire chastity). (24:33)”  (Translation of Sunan Abu Dawud, Divorce (Kitab Al-Talaq), Book 12, Number 2304)”
So here we have a direct and explicit refutation to the precise argument of the critic. A man was forcing his slave girl into fornication, and so the Quran revealed a verse that said that you are not allowed to force slave girls, i.e. right hand captives, into fornication.
 
Hence the Quran completely refutes the argument of Muslims supposedly being allowed to rape or force their right hand captives into sex, this is a figment of the critics own warped imagination.
Now from the hadiths, and we read the following and very interesting hadith concerning how a Muslim must treat their right hand captive:
Prophet Muhammad peace be upon him ordered his followers to be kind to their slaves: Narrated Al-Ma’rur: At Ar-Rabadha I met Abu Dhar who was wearing a cloak, and his slave, too, was wearing a similar one. I asked about the reason for it. He replied, “I abused a person by calling his mother with bad names.” The Prophet said to me, ‘O Abu Dhar! Did you abuse him by calling his mother with bad names You still have some characteristics of ignorance. Your slaves are your brothers and Allah has put them under your command. So whoever has a brother under his command should feed him of what he eats and dress him of what he wears.  Do not ask them (slaves) to do things beyond their capacity (power) and if you do so, then help them.’   (Translation of Sahih Bukhari, Book 2, Belief, Volume 1, Book 2, Number 29)”
According to this hadith, the Prophet Muhammad (pbuh) said that slaves are like our brothers; basically they are to be treated properly, and not to be abused. They are to be fed and clothed by the same things we eat and dress with. Now how on earth can one make the argument that Islam allows Muslims to rape their right hand captives when you have a hadith telling Muslims their right hand captives are like family and that they are not be abused?
 
Last but not least, we now turn our attention to what the classical scholars of Islam have said about the issue.
 
Imam Malik, founder of the Maliki School of jurisprudence said:
In our view the man who rapes a woman, regardless of whether she is a virgin or not, if she is a free woman he must pay a “dowry” like that of her peers, and if she is a slave he must pay whatever has been detracted from her value. The punishment is to be carried out on the rapist and there is no punishment for the woman who has been raped, whatever the case.  (Imam Maalik, Al-Muwatta’, Volume 2, page 734)
Imam Shaafi founder of the Shaafi School of jurisprudence said:
“If a man acquires by force a slave-girl, then has sexual intercourse with her after he acquires her by force, and if he is not excused by ignorance, then the slave-girl will be taken from him, he is required to pay the fine, and he will receive the punishment for illegal sexual intercourse. (Imam Al Shaafi’i, Kitaabul Umm, Volume 3, page 253)
So in conclusion, Islam does not allow Muslims to rape their right hand captives, no such texts exist, on the contrary from what we have just seen, Islamic texts clearly forbid such acts.

Is rape a crime in Islam? Yes!

The renowned Saudi scholar, Sheikh Muhammad Saleh Al-Munajjid, condemns the act of rape and describes it as a CRIME which is FORBIDDEN and punishable:

This is an abhorrent crime that is forbidden in all religions and in the minds of all wise people and those who possess sound human nature. All earthly systems and laws regard this action as abhorrent and impose the strictest penalties on it.

Islam has a clear stance which states that this repugnant action is haram (forbidden) and imposes a deterrent punishment on the one who commits it [2]
 
Is rape oppression and injustice? Yes!

Here we see a comment by Sheikh Hamza Yusuf on rapists. Sheikh Hamza Yusuf believes rape is oppression and injustice:

The rapist oppresses by taking advantage of the physical weakness of his victim. Oppression is a form of injustice, and injustice always occurs from an abuse of power, hidden or manifest. [The Prayer of the Oppressed, Hamza Yusuf,Sandala Productions, 2010, Kindle Loc. 175]
 
So it is a myth to say Islam condones rape or allows rapists to go free? Yes!

This is confirmed by Sheikh Faraz Rabbani:

However, it is a myth to say that Islam would in any way condone rape, or allow a rapist to go free for this terrible crime against an innocent human being and against society

So, the hadd punishment requires four witnesses but other discretionary punishments for the rapists do not? Correct!

Ibn `Abdul-Barr said:

The scholars are unanimously agreed that the rapist is to be subjected to the hadd punishment if there is clear evidence against him that he deserves the hadd punishment, or if he admits to that. Otherwise, he is to be punished (that is, if there is no proof that the hadd punishment for zina may be carried out against him because he does not confess and there are not four witnesses, then the judge may punish him and stipulate a punishment that will deter him and others like him)… (Al-Istidhkaar, 7/146). [2]

Can the rapist still receive hadd punishment even if he does not use a weapon? Yes!

Sheikh Mohammad Saleh al Munajjid writes: In addition, the rapist is subject to the hadd punishment for zina, even if the rape was not carried out at knifepoint or gunpoint.


What about rape at knifepoint?

Sheikh al Munajjid states: If the use of a weapon was threatened, then he is a muharib, and is to be subjected to the hadd punishment described in the verse in which Allah says (The recompense of those who wage war against Allah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off from opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter) (Al-Ma’idah 5:33).

So the judge has the choice of the four punishments mentioned in this verse and may choose whichever he thinks is most suitable to attain the objective, which is to spread peace and security in society, and ward off evildoers and aggressors. [2]

Rape statistics are relatively low in Muslim countries

NationMaster’s per capita rape statistics do not include a Muslim country in the top 30. The statistics show the US, UK, Australia, Canada, Spain and France as having more rapes per capita than any Muslim country. [4]

Muslim Condemns Sick Imam Who Raped a Girl in Mosque

Muslim condemns sex crime and hate


Sexually perverted people belong to all religions. Islam is no different. Sadly for Muslims, when a sick Muslim commits a sexual crime it's used as a propaganda tool to attack all Muslims and even Islam by right-wing Islamophobes.


That's exactly what's happening with the story of a sick imam in Afghanistan who brutally raped a 10 year old girl in a mosque. Notice the parallels between this account and the accounts of Christian priests and pastors who commit similar sexual crimes on young girls and boys. The difference is, the sick sexual crimes by the Christian leaders are, on the whole, not used as propaganda pieces to attack all Christians and Christianity. This is not the case when a Muslim commits similar sick acts:
Kunduz, Afghanistan:  It was bad enough that the alleged rape took place in the sanctity of a mosque and that the accused man was a mullah who invoked the familiar defense that it had been consensual sex.

But the victim was only 10 years old. And there was more: The authorities said her family members openly planned to carry out an honor killing in the case - against the young girl. The mullah offered to marry his victim instead.


As a Muslim I condemn the sick sexual crime committed by this imam regardless of where it took place. However the corruption is even more apparent as he committed his crime in a mosque according to the report.

As a Muslim I pray that this girl makes a full recovery and is protected from further harm. Ameen.

We have already seen Islam does not allow rape as per the comments of famous Muslim scholars.

The worry for this Afghan rape victim is that of honor killing now:

Honor killings in rape cases are common in Afghanistan, and are often more important to the victim's family than vengeance against the attacker. Human rights groups say about 150 honor killings a year come to light, and many more probably go unreported.

Honor killing is another backward practice which learned Muslims have condemned. It's something that is not allowed in Islam as seen in this video featuring Sheikh Hamza Yusuf and Dr Bilal Philips.

All in all, reports of crimes such as these should never be misused for purposes of an anti-Muslim campaign. The ignorant crimes of a Muslim in Afghanistan or wherever is not synonymous with Islam and is not representative of the Muslim global community. Just like the sexual crimes of Christian priests and pastors are not reflective of Christianity and/or other Christians.

Muslim Imam Speaks Out Against Rape - Rape is a 'sin' and 'crime'

Are Muslims Allowed to Rape Slave Women? No.

Post 9-11 propaganda against Islam attempts to portray Muslims as hordes waiting to invade the West to butcher, enslave and rape. One such propaganda piece is that 'Muslims are allowed to rape female slaves/captives'. This is simply propaganda which is designed to further the fear-mongering and hatred of Muslims.

Is rape of slave girls allowed?

Rape of a slave girl is an extremely violent act. Yet, Prophet Muhammad(P) condemned even slapping a slave:
Zadhan Abl Umar reported: I came to Ibn 'Umar as he had granted freedom to a slave. He (the narrator further) said: He took hold of a wood or something like it from the earth and said: It (freedom of a slave) has not the reward evert equal to it, but the fact that I heard Allah's Messenger (way peace be upon him) say: He who slaps his slave or beats him, the expiation for it is that he should set him free.

"He who slaps his slave" means both male and female:

Hilal b. Yasaf reported that a person got angry and slapped his slave-girl. Thereupon Suwaid b. Muqarrin said to him: You could find no other part (to slap) but the prominent part of her face. See I was one of the seven sons of Muqarrin, and we had but only one slave-girl. The youngest of us slapped her, and Allah's Messenger (may peace be upon him) commanded us to set her free.

The second you strike a slave, she is no longer your property and she is free. You now have no rights upon her. Therefore it is impossible to commit this act if you can not even slap nor beat a slave.

If you can not beat then how can you rape!

Is there any instance of rape in the Islamic sources?

Many may not know this, but the Islamic historical references are so vast and tremendous, a western audience has never seen anything the size it:

Yet those anti-Islamic critics will have us to believe that tens of thousands of women are being brutally raped! Yet you can not find 1 single instance of this happening in this vast amount of historical data!

Conclusion

So here we see even slapping a slave girl is not allowed. Therefore we realise, it's obvious rape is not allowed as rape entails violence and hurt towards the slave girls (something which is forbidden in Islam).

We also see there is no source (despite the vastness of the Islamic source texts) in Islamic texts which show an instance of rape. Thus it's unfair and disingenuous to present claims of rape.

Forced Sex with Slaves in Islam?

Here the well respected and learned Sheikh Atabek Shukrov Nasafi  confirms raping slave girls is not allowed in Islam. I have produced some bullet points to summarise his presentation below the video.

~ The sheikh could not find anything in Hanafi fiqh which taught forced sex of slaves is allowed.

~ The sheikh cites the Quran (4:36) to show that one should be good to the slaves (obviously rape is not treating slaves well thus rape does not seem to be allowed in Islam)

Worship Allah and join none with Him in worship, and do good to parents, kinsfolk, orphans, Al-Masakin (the poor), the neighbour who is near of kin, the neighbour who is a stranger, the companion by your side, the wayfarer (you meet), and those (slaves) whom your right hands possess. Verily, Allah does not like such as are proud and boastful [Translation of the meanings of Quran 4:36 by Muhsin Khan]

~ The sheikh also cites Quran 24:33 to show that slave women cannot be forced into prostitution

And let those who find not the financial means for marriage keep themselves chaste, until Allah enriches them of His Bounty. And such of your slaves as seek a writing (of emancipation), give them such writing, if you know that they are good and trustworthy. And give them something yourselves out of the wealth of Allah which He has bestowed upon you. And force not your maids to prostitution, if they desire chastity, in order that you may make a gain in the (perishable) goods of this worldly life. But if anyone compels them (to prostitution), then after such compulsion, Allah is Oft-Forgiving, Most Merciful (to those women, i.e. He will forgive them because they have been forced to do this evil action unwillingly). [Translation of the meanings of Quran 24:33 by Muhsin Khan]

Thus we see slave women cannot be forced into sex with others (prostitution).

~ The sheikh refers to a narration where Prophet Muhammad (p) repeated (many times) the order to take care of your slaves.

[Obviously, rape would be against such a teaching. Thus one would not imagine rape to be allowed in Islam]

~ The sheikh cites a hadith where we learn the Prophet taught that the slaves should be fed the same food as the slave master, the same clothes should be given to the slave as those worn by the slave-master and the slave-master should not make the slaves do something which is difficult for them - if they are made to do the difficult task the slave-master must help the slave.

[Of course forced sex is much worse than not feeding or clothing the slave to one's own standard - thus one would not imagine rape of slaves to be allowed. Think about it]

~ The sheikh also makes mention of a narration which teaches us not to punish or oppress slaves.

[Of course based on this and the nature of rape one would not consider rape to be allowed]

~ The sheikh cites a hadith where we see burning the slave and/or cutting their noses/ears is not accepted - the slave must be freed if this was to occur.

~ The sheikh cites a hadith in which we see the slaves' emotional feelings are considered as a slave master cannot even call them by the term 'my slave' and a more sensitive term should be used.

[Think about it, if the slave's emotional feelings are considered how can one say rape is allowed when rape not only involves physical pain but also emotional pain - both of which are not allowed in Islam]

~ The sheikh cites a hadith which shows beating or slapping a slave is not allowed

[Rape involves elements of violence - thus how can one say rape of slaves is allowed when violence towards slaves is not allowed?]

~ The sheikh cites a narration where we see killing the slave is not allowed and nor is castrating (chopping off the private parts)

The sheikh also teaches sexual intercourse with slave girls is similar to the manner one has intercourse with their wife (i.e. not like an animal, trying to satisfy the wife during sex, preparing before intercourse).

[Thus one can see that saying rape of slave girls is allowed is unfair]




Conclusion

The basic theme is here, one cannot physically hurt his slave thus rape is not allowed as rape entails traumatic pain. We see that slaves' feelings are not allowed to even be hurt thus further indicating rape is not something which is allowed by Islam. Also note that the sheikh taught that the intercourse with the slave girl is similar to that of with the wife (where the wife's sexual satisfaction is considered too).

We also see there was nothing found in the Hanafi school of jurisprudence which supports the claim of rape being allowed.

Bassam Zawadi in this article shows rape to be something which is not allowed in Islam. Aside from the theme above Bassam introduces new themes for thought - one of which being the view of some scholars where the slave girl has to convert to Islam before any intercourse can be had with a slave girl who happened to be an idol-worshipper.

His concluding remarks:

Islam forbids one to harm those under his authority. Since rape is considered a form of harm that would mean that rape is forbidden. We have also seen that history shows that slave girls in the past did consent to having sex with their captors; hence we must keep our subjective emotions aside and agree with this objective fact. In light of this fact, there is nothing absurd in believing that the Muslims did not rape their slave girls especially since they were forbidden from doing so. And even if some of the Muslims back then did rape their slave girls, this would only show that they committed a sinful act and not that the Prophet (peace be upon him) approved of such behavior. In conclusion, Islam does not permit the Muslim man to rape his slave girl.
